Er konnte es nicht mit seinem Gewissen vereinbaren, in seiner Apotheke in Berlin, die \u201aPille danach\u2018 zu verkaufen. Daraufhin leitete die Apothekerkammer Berlin 2018 rechtliche Schritte gegen ihn ein.<\/p><p>Das erstinstanzliche Urteil fiel dabei zu Kerstens Gunsten aus. Dies war das erste Mal, dass ein deutsches Gericht feststellte, dass es einem Pharmazeuten freistehe, beim Verkauf von gewissen Produkten in Einklang mit seinem Gewissen zu handeln. Die Apothekerkammer legte gegen dieses Urteil Berufung ein. Im Juni 2024 sprach das Oberverwaltungsgericht Berlin-Brandenburg Andreas Kersten endg\u00fcltig frei. Dies begr\u00fcndete er damit, dass durch die \u201aPille danach\u2018 die Einnistung der befruchteten Eizelle verhindert und so der Tod eines ungeborenen Kindes herbeigef\u00fchrt werden kann.<\/p><p>Im Juli 2018 wurde Kersten bei der\u202fApothekerkammer Berlin\u202fangezeigt, die daraufhin Klage beim Berufsgericht f\u00fcr Heilberufe beim Verwaltungsgericht Berlin\u202feinreichte. Ihm wurde vorgeworfen, dass er sich zweimal weigerte die \u201aPille danach\u2018 zu verkaufen, dieses Pr\u00e4parat nicht vorr\u00e4tig in seiner Apotheke f\u00fchrte und Patientinnen Zettel mit Alternativen zur \u201aPille danach\u2018 oder zu Kontrazeptiva gab.<\/p><p>Am 26. November 2019 gab das Berufsgericht f\u00fcr Heilberufe beim Verwaltungsgericht Berlin Andreas Kersten recht und bekr\u00e4ftigt die Gewissensfreiheit des Apothekers. Bis auf eine \u201eWarnung\u201c wegen eines geringf\u00fcgigen Versto\u00dfes gegen Datenschutzrecht, den Andreas Kersten nicht bestritt und bereits vor Jahren abgestellt hatte, sprach das Gericht ihn vom Vorwurf der Berufspflichtverletzung frei. Dabei entscheid ein deutsches Gericht erstmals zugunsten eines Apothekers, der aus Gewissensgr\u00fcnden davon absah, bestimmte Produkte zu verkaufen.<\/p><p>\u201eDas erstinstanzliche Urteil war eine klare Aussage, dass der Apotheker das Recht hatte, nach seinem Gewissen zu handeln und dabei seine Berufspflicht nicht verletzt hat. Das Recht auf Gewissensfreiheit muss auch das Recht beinhalten, dementsprechend zu handeln. Der Fall wurde am Oberverwaltungsgericht Berlin-Brandenburg weiterverhandelt.<\/p><p>Erst vier Jahre sp\u00e4ter, am 26. Juni 2024, fiel das endg\u00fcltige Urteil. Nach zweieinhalbst\u00fcndiger Verhandlung und zweist\u00fcndiger Beratung hinter verschlossenen T\u00fcren sprach das Oberverwaltungsgericht Berlin-Brandenburg Andreas Kersten vom Vorwurf der Berufspflichtverletzung frei. Die Berufung der Apothekerkammer wurde kostenpflichtig zur\u00fcckgewiesen.\u00a0<\/p><p>Zugleich stellte das Gericht aber in der Urteilsbegr\u00fcndung das Recht auf Gewissensfreiheit von Apothekern in Frage. Kersten sei ein \u201eunvermeidlicher rechtlicher Irrtum\u201c unterlaufen, als er glaubte vom Verkauf der \u201aPille danach\u2018 aus Gewissensgr\u00fcnden absehen zu d\u00fcrfen. Er habe es also nicht besser wissen k\u00f6nnen, doch die individuelle Gewissensfreiheit sei dem Versorgungsrecht untergeordnet. Ein Apotheker, der die Abgabe bestimmter Pr\u00e4parate nicht mit seinem Gewissen vereinbaren k\u00f6nne, m\u00fcsste den Konflikt dadurch l\u00f6sen, dass er seinen Beruf aufgebe. Obwohl die problematische Urteilsbegr\u00fcndung au\u00dfer f\u00fcr Herrn Kersten keinerlei Bindungswirkung hat, bleibt die Bef\u00fcrchtung, dass staatliche Stellen immer seltener bereit sind, Gewissensentscheidungen f\u00fcr das ungeborene Leben zu respektieren. Zuk\u00fcnftig k\u00f6nnten sich in Berlin also selbstst\u00e4ndige Apotheker zwischen ihren \u00dcberzeugungen, ihrem Gewissen, und ihrem Beruf entscheiden m\u00fcssen.\u00a0<\/p><p>\u201eNach einem Verfahren durch mehrere Instanzen und nach \u00fcber 5 Jahren Unsicherheit ist jetzt klar, dass Andreas Kersten in seiner Gewissensnot nicht schuldhaft gegen Berufspflichten versto\u00dfen hat. Dar\u00fcber freuen wir uns. Skandal\u00f6s ist aber die Begr\u00fcndung des Urteils. Das Gericht f\u00fchrte zun\u00e4chst nur m\u00fcndlich aus, dass sich Apotheker zuk\u00fcnftig zwischen ihren \u00dcberzeugungen und ihrem Beruf entscheiden m\u00fcssen. Wir werden die Begr\u00fcndung genau pr\u00fcfen,\u201c sagte Dr. Felix B\u00f6llmann.\u00a0<\/p><p><strong>Gezwungen, seinen Beruf aufzugeben\u00a0<\/strong><\/p><p>Aus gesundheitlichen Gr\u00fcnden beschloss Kersten bereits kurz nach Er\u00f6ffnung des Verfahrens 2018, seine Apotheke zu schlie\u00dfen. Doch er blieb w\u00e4hrend des langwierigen Gerichtsprozesses Mitglied der Apothekerkammer und schloss eine R\u00fcckkehr in den Beruf nicht aus.\u00a0\u00a0<\/p><p>Nachdem die Richter im letztinstanzlichen Urteil die Auffassung vertreten hatten, er m\u00fcsse sich zwischen seinem Gewissen und seiner Berufsaus\u00fcbung entscheiden, kam Kersten zu dem Schluss, dass er aus Gewissensgr\u00fcnden seinen Beruf als Apotheker nun endg\u00fcltig nicht mehr aus\u00fcben kann.\u00a0<\/p><p>Im Mai 2025 bat Kersten die Apothekerkammer seine 1984 erteilte Approbation als Apotheker zur\u00fcckzunehmen. Er gab an, aufgrund des Urteils des Oberverwaltungsgericht Berlin-Brandenburg in seinem Fall, den Beruf aus Gewissensgr\u00fcnden nicht mehr aus\u00fcben zu k\u00f6nnen.\u00a0<\/p><p>\u201eEs ist bedauernswert, dass Apothekern das Recht auf Gewissensfreiheit abgesprochen wird, wenn sie eine lebensachtende Haltung einnehmen.\u202fDie sogenannte \u201aPille danach\u2018 zu verkaufen, kann ich mit meinem Gewissen nicht vereinbaren, weil sie m\u00f6glicherweise ein Menschenleben beenden k\u00f6nnte.\u202fDaher sehe ich mich gezwungen meine Approbation als Apotheker aufzugeben\u201c, begr\u00fcndet Kersten seine Entscheidung.\u00a0<\/p><p><strong>Gewissensfreiheit im Rechtstaat und internationalen Recht\u00a0<\/strong><\/p><p>Niemand sollte aufgrund seines Gewissen in einem freien demokratischen Staat dazu gezwungen werden, den Beruf zu wechseln.\u00a0<\/p><p>\u201eDas Oberverwaltungsgericht Berlin setzt sich mit seiner Argumentation in direkten Widerspruch zum internationalen Recht. Grundrechte m\u00fcssen effektiv garantiert werden, nicht nur auf dem Papier. Aber die Argumentation des Gerichts l\u00e4sst der Gewissensfreiheit keinen Raum. Gewissenskonflikte m\u00fcssen im Rechtsstaat, der sowohl Gewissens-, als auch Berufsfreiheit garantiert, anders als durch einen Berufswechsel gel\u00f6st werden\u201c, so B\u00f6llmann weiter.\u00a0<\/p><p>Die Begr\u00fcndung des Gerichts wirkt auch im Hinblick auf die offizielle Handlungsempfehlungen der Bundesapothekerkammer \u201eRezeptfreie Abgabe von oralen Notfallkontrazeptiva (\u201aPille danach\u2018)\u201c fragw\u00fcrdig.
