in front of\u00a0the Frankfurt branch of the\u00a0Pro Familia abortion\u00a0organisation\u00a0in 2020 \u2013 so\u00a0<\/span><a href=\"https:\/\/verwaltungsgerichtsbarkeit.hessen.de\/pressemitteilungen\/erfolgreiche-klage-gegen-einschr%C3%A4nkungen-der-versammlungsfreiheit-vor-der-pro\"><span data-contrast=\"none\">ruled<\/span><\/a><span data-contrast=\"none\">\u00a0the\u00a0Administrative Court\u00a0of Frankfurt,\u00a0Hesse,\u00a0in a\u00a0judgment\u00a0handed down\u00a0on 16 December.\u00a0The\u00a0geographic\u00a0and temporal restrictions on the\u00a0pro-life\u00a0meetings near the\u00a0abortion\u00a0organisation\u00a0ordered by the city of Frankfurt were found to be unlawful.\u00a0The Court affirmed the right to free speech and free assembly.\u00a0Pavica Vojnovi\u0107, leader of a 40-Days-for-Life group in Pforzheim,\u00a0welcomed the decision\u00a0after recently receiving permission to appeal in her case which raises similar issues.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">Dr. Felix\u00a0B\u00f6llmann, Senior Counsel at ADF International, a human rights\u00a0organisation\u00a0which is\u00a0supporting\u00a0Vojnovi\u0107\u2019s case\u00a0stated: \u201cWe welcome the\u00a0court\u2019s ruling in Frankfurt which protects the fundamental freedoms\u00a0of speech,\u00a0expression\u00a0and assembly.\u00a0The people\u00a0making an effort\u00a0to protect the right to life should not\u00a0have been\u00a0prohibited from\u00a0peacefully\u00a0exercising\u00a0these freedoms\u00a0in the first place.\u00a0We are hopeful that\u00a0this ruling will\u00a0set a positive\u00a0example\u00a0for cases such as data-contrast=\"none\">The court\u2019s decision in Frankfurt\u00a0sets a\u00a0positive\u00a0example\u00a0for further\u00a0free speech and free assembly\u00a0cases.\u00a0In its reasoning, the\u00a0court affirmed that the law guarantees the holders of fundamental rights the right to\u00a0determine\u00a0the place, time,\u00a0nature\u00a0and content of their meeting.\u00a0Regarding\u00a0the city\u2019s argument of wanting to avoid women\u00a0being confronted with unwanted messaging in public, the court pointed out that &#8222;[t]here is no room in the given legal system for such protection against confrontation with other views that are not desired.&#8220;*<\/span><span Court of Appeals (Verwaltungsgerichtshof)\u00a0in Mannheim, Baden-W\u00fcrttemberg,\u00a0announced it will hear the appeal against\u00a0the\u00a0prohibition on silent prayer gatherings in the proximity of an abortion organization\u00a0in Pforzheim. This May, a lower court had dismissed the challenge\u00a0of\u00a0Pavica Vojnovi\u0107\u00a0to have restrictions on\u00a0her group\u2019s\u00a0prayer vigils lifted. Vojnovi\u0107, the leader of the \u201c40 Days for Life\u201d group in Pforzheim, Germany, had challenged the ban on the grounds of the right to freedom of religion,\u00a0assembly\u00a0and speech. Her group is currently prohibited from gathering to peacefully pray in the proximity of a Pro Familia abortion advisory center. Experts welcomed the decision by the\u00a0court\u00a0in Mannheim.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">\u201cIt is encouraging that the court sees merit in\u00a0Pavica\u2019s\u00a0case. Hopefully, it will grasp this opportunity to uphold freedom of expression,\u00a0assembly\u00a0and religion. In dismissing the case, the lower court failed to affirm these freedoms which are the foundation of every free and fair democracy. Twice a year, around 20 people had gathered to pray for the women facing abortion, and the lives of their unborn children. The vigils took place for\u00a040 days\u00a0\u2013 silently and peacefully. Vojnovi\u0107 and her group were not preventing anybody from entering the building, nor were they blocking the pavement in the surrounding area. Regardless, the municipality has banned them from praying in sight of the Pro Familia abortion advisory\u00a0centre.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">The prayer vigils were peaceful throughout. When\u00a0monitored\u00a0by the police at the request of Pro Familia, no violations of any law were found; and yet, the management of the\u00a0centre\u00a0requested\u00a0that the vigil be moved some distance away or banned altogether.\u00a0\u00a0\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">\u201cEvery life is valuable and deserves protection. I am shocked that we are being prevented from supporting vulnerable women and their unborn children in prayer.\u00a0It\u2019s\u00a0discouraging to hear that silent prayer vigils in a public place are restricted by local authorities. Our society must offer better support to mothers in\u00a0difficult situations. This is about more than our group in Pforzheim.\u00a0It\u2019s\u00a0about whether prayer-free zones are lawful, or whether one is allowed to\u00a0represent\u00a0different opinions in the public square. That is why we will continue fighting for this freedom,\u201d said Pavica Vojnovi\u0107, who, with the support of human rights organization ADF International,\u00a0is\u00a0continuing\u00a0to seek justice in court to restore her fundamental rights to freedom of religion, assembly and speech.<\/span><span
