href=\"https:\/\/adfinternational.org\/commentary\/nigeria-most-dangerous-country-christians\" target=\"_blank\" rel=\"noopener\">most dangerous countries<\/a> in the world for Christians \u2014 and anyone else daring to express beliefs that deviate from the dominant religious perspective.<\/p><p>This reality is starkly highlighted in the cases of Mubarak Bala, <a href=\"https:\/\/adfinternational.org\/cases\/rhoda-jatau-nigeria\" target=\"_blank\" rel=\"noopener\">Rhoda Jatau<\/a>, and <a href=\"https:\/\/adfinternational.org\/cases\/yahaya-sharif-aminu\" target=\"_blank\" rel=\"noopener\">Yahaya Sharif-Aminu<\/a> \u2014 three individuals from different religious backgrounds whose lives have been derailed by accusations of blasphemy in Northern Nigeria, a region living under sharia law.<\/p><p>Their experiences, along with countless other persecuted Nigerians, highlight a troubling trend: <a href=\"https:\/\/adfinternational.org\/news\/un-appeal-nigeria\" target=\"_blank\" rel=\"noopener\">Nigeria\u2019s blasphemy laws<\/a> are weaponized to silence dissent. They enable mob violence, distort legal processes through Islamic extremism, and leave innocent individuals vulnerable to persecution simply for their beliefs or expressions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d2377e2 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d2377e2\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-ddaf5f1\" data-id=\"ddaf5f1\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3cb8958 elementor-widget elementor-widget-heading\" data-id=\"3cb8958\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Prisoners of Blasphemy Laws in Nigeria<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f61de2 elementor-widget elementor-widget-text-editor\" data-id=\"6f61de2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><a href=\"https:\/\/thehumanist.com\/news\/international\/humanist-mubarak-bala-freed-in-nigeria\" target=\"_blank\" rel=\"noopener\">Mubarak Bala<\/a>, the president of the Humanist Association of Nigeria, became a target of these draconian blasphemy laws after posting on social media. What followed was swift and tragic: an arrest, public vilification, and legal charges that completely disregarded his basic rights.<\/p><p>Mubarak was arrested in April 2020 following complaints about posts he made on Facebook, which were deemed offensive to Islam. In 2022, he was convicted of eighteen counts related to blasphemy under Sections 210 and 114 of the Kano State Penal Code and was <a href=\"https:\/\/www.bbc.com\/news\/articles\/c62zpk4nnxdo\" target=\"_blank\" rel=\"noopener\">sentenced<\/a> to twenty-four years in prison.<\/p><p>His supposed \u201ccrime\u201d was speaking openly against Islamic beliefs.<\/p><p>His case was marred by numerous irregularities, including being detained without charges for nearly a year and a half, being denied access to legal counsel, family, and medical care, and experiencing significant delays in his trial.<\/p><p>After serving four and a half years in prison, Mubarak was recently released.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7d27fb3 elementor-widget elementor-widget-heading\" data-id=\"7d27fb3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">ADF International Cases<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9f094f elementor-widget elementor-widget-text-editor\" data-id=\"f9f094f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Our clients, Rhoda Jatau and Yahaya Sharif-Aminu have faced similar <a href=\"https:\/\/adfinternational.org\/campaign\/support-the-persecuted-nigeria\" target=\"_blank\" rel=\"noopener\">persecution<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0718907 elementor-widget elementor-widget-heading\" data-id=\"0718907\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Rhoda Jatau<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-993540f elementor-widget elementor-widget-text-editor\" data-id=\"993540f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Rhoda, a lifelong civil servant in Bauchi State, Nigeria, was imprisoned in 2022 for 19 months for allegedly sharing a video on WhatsApp condemning the lynching of Deborah Emmanuel Yakubu, a Nigerian student who was murdered and set on fire by a mob of her classmates for sharing her Christian faith.<\/p><p>As a result, Rhoda was charged with \u201cinciting public disturbance\u201d and \u201cexciting contempt of religious creed\u201d under Sections 114 and 210 of the Bauchi State Penal Code.<\/p><p>From the time of her arrest, Rhoda was repeatedly denied bail and detained incommunicado, only having intermittent access to legal counsel and family members during court appearances. With our support, along with allied lawyers on the ground in Nigeria, Rhoda was <a href=\"https:\/\/adfinternational.org\/news\/victory-rhoda-jatau\" target=\"_blank\" rel=\"noopener\">acquitted<\/a> in December of last year. She remains in a now safe, undisclosed location.<\/p><p>Mubarak Bala and Rhoda Jatau\u2019s blasphemy charges essentially functioned as sharia laws for alleged blasphemy <a href=\"https:\/\/adfinternational.org\/news\/christian-mother-on-bail-after-19-months-in-nigerian-prison-for-blasphemy\" target=\"_blank\" rel=\"noopener\">against Islam<\/a>, even though they were charged under state penal codes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f07df4d elementor-widget elementor-widget-heading\" data-id=\"f07df4d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Yahaya Sharif-Aminu<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7ba243 elementor-widget elementor-widget-text-editor\" data-id=\"e7ba243\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Yahaya Sharif-Aminu, a young Sufi musician in Kano State, Nigeria, has faced his state\u2019s sharia criminal laws directly. Unfortunately, Yahaya still languishes in prison.<\/p><p>In 2020, Yahaya was convicted and sentenced to death by hanging, despite not having legal representation, for sending song lyrics on WhatsApp that were deemed blasphemous towards the prophet Muhammad.<\/p><p>His conviction was overturned, and a new trial was ordered in January 2021 because of procedural irregularities in the original trial. Yahaya appealed this decision, claiming that the case should be dropped completely and that the law against blasphemy should be declared unconstitutional, but a Court of Appeal upheld the retrial order.<\/p><p>Yahaya has now filed an appeal with the <a href=\"https:\/\/adfinternational.org\/free-yahaya\" target=\"_blank\" rel=\"noopener\">Supreme Court of Nigeria<\/a>, in the first case of its kind that could overturn the country\u2019s death penalty blasphemy laws found in its sharia criminal codes. In the meantime, Yahaya still faces a potential death penalty.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-227cfdc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"227cfdc\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d966841\" data-id=\"d966841\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-fbba08f elementor-widget elementor-widget-heading\" data-id=\"fbba08f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Commonalities among Mubarak, Rhoda, and Yahaya<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-312370a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"312370a\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4a55510\" data-id=\"4a55510\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4596fa5 elementor-widget elementor-widget-text-editor\" data-id=\"4596fa5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This trio of cases exhibits notable similarities, highlighting the pervasive nature of blasphemy laws and the extent of state overreach in enforcing them.\u00a0<\/p><p>Mubarak, Rhoda, and Yahaya come from northern Nigeria, a predominantly Muslim region, where challenging the majority Islamic ideology often leads to severe legal and socio-cultural repercussions.<\/p><p>Although all three come from different religious backgrounds, each has faced persecution under the same oppressive system. Rhoda, a Christian, is a target simply because her faith conflicts with the region\u2019s dominant ideology. Mubarak, an atheist, challenges the foundation of religious authority, placing him in direct conflict with sharia law. And Yahaya, a minority Muslim, shows that even those within Islam aren\u2019t safe.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-83017ef elementor-widget elementor-widget-heading\" data-id=\"83017ef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Online Censorship<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2c5634 elementor-widget elementor-widget-text-editor\" data-id=\"f2c5634\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In all three cases, the alleged \u201ccrimes\u201d involved online or digital expressions deemed offensive by Islamic authorities. These digital acts, rooted in personal belief and freedom of expression, have been met with unjust legal and social consequences.<\/p><p>All three have been denied fair trials. And all three have lived in fear for their lives.\u00a0<\/p><p>Sharia blasphemy laws function not only as a religious legal system but also as a repressive tool for controlling all forms of expression, making it one of the most severe forms of censorship.<\/p><p>These are only a snippet of cases highlighting Nigerian persecution. Recent reporting shows that <a href=\"https:\/\/www.catholicnewsagency.com\/news\/261571\/nigeria-tops-report-for-number-of-christians-killed-kidnapped-in-2024?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\">3,100 Christians<\/a> were killed and 2,830 kidnapped in Nigeria last year, far more than in other countries in the same year. Disturbingly, the stats are believed to be higher since many cases remain unreported. Since 1999, most northern states in Nigeria have operated under this framework.<\/p><p>The sharia criminal statute that Yahaya was convicted under calls for the death penalty for any Muslim who \u201cinsults\u201d the Quran or its prophets. The non-sharia blasphemy laws call for imprisonment for so-called \u201creligious insults\u201d and can apply to anyone, often being used as substitute Sharia laws.<\/p><p>Nonetheless, Nigeria is officially a secular <a href=\"https:\/\/www.persecution.org\/wp-content\/uploads\/2021\/09\/secular_sharia.pdf\" target=\"_blank\" rel=\"noopener\">federation<\/a>, with power divided between the national government and individual state governments. Within this structure, state governments have the power to shape their system of law so long as they adhere to the Nigerian Constitution, which is supposed to protect fundamental human rights.<\/p><p>The cases of Rhoda, Mubarak, and Yahaya expose glaring contradictions between sharia and blasphemy laws, and constitutional guarantees.
