A coalition of 27 faith leaders, alongside Glasgow priest Canon Tom White, had challenged the proportionality of the ban in a legal challenge that was heard on March 11<sup>th<\/sup>-12<sup>th<\/sup>.\u00a0The ruling\u00a0could\u00a0prevent similar blanket bans on public worship from being\u00a0imposed in the future\u00a0by Holyrood.<\/p>\n<p>\u201cI\u2019m\u00a0overjoyed to hear that the\u00a0court\u00a0has\u00a0understood the\u00a0essential\u00a0need to protect not only the physical and material health of our society but also its spiritual needs and therefore overturned the disproportionate, unnecessary and unlawful blanket ban on public worship.\u00a0This decision highlights the significance of the church\u2019s role in society. Now, we can trust that our fragile and damaged communities will never again be left without\u00a0the church as\u00a0a source of hope, comfort, and vital spiritual nourishment in times of crisis. I\u2019m grateful to\u00a0all across\u00a0Scotland and beyond who have offered their financial support for my case, and who have faithfully prayed with me for church doors to be\u00a0reopened. Thanks be to God for this wonderful news!\u201d said Canon White, upon learning\u00a0of\u00a0the decision.<\/p>\n<p>The government announced a major concession the night before the\u00a0judgment, stating in parliament that\u00a0churches would reopen with\u00a0<u>a cap of 50 worshippers this Friday.<\/u><\/p>\n<p>Human rights experts at ADF UK had supported Canon Tom&#8217;s case with the Let Us Worship campaign.<\/p>\n<p><strong>\u201cAn extraordinary abuse of the state\u2019s power\u201d<\/strong><\/p>\n<p class=\"paragraph\" style=\"margin: 0in; margin-bottom: .0001pt; text-align: justify; vertical-align: baseline;\"><span class=\"normaltextrun\"><span style=\"color: black;\">The court noted that churches had been treated unfairly in comparison to other public places, which had been allowed to open throughout the latest lockdown. Even cinemas have been opened for the purposes of Sheriff Court jury trials.<\/span><\/span><\/p>\n<p>Lord Braid also rejected the government\u2019s argument that believers could simply worship online. The Catholic Church, for one, considers sacraments, which must take place in person, to be essential.<\/p>\n<p>&#8220;While some people may derive some benefit from being able to observe on-line services, it is undeniable that certain aspects of certain faiths simply cannot take place, at all, under the current legislative regime,&#8221; read the decision issued by Lord Braid.<\/p>\n<p>\u201cIt is impossible to measure the effect of those restrictions on those who hold religious beliefs. It goes beyond mere loss of companionship and an inability to attend a lunch club,\u201d he continued.<\/p>\n<p>The government \u201chave admittedly paid lip service to article 9 by referring to it, but there is no evidence that they have accorded it the importance which such a fundamental right deserves.\u201d<\/p>\n<p class=\"paragraph\" style=\"margin: 0in; margin-bottom: .0001pt; text-align: justify; vertical-align: baseline;\"><span style=\"color: black;\">\u201cFor all these reasons, I have concluded that the Regulations do constitute a disproportionate interference with the article 9 right of the petitioners and others,\u201d concluded the Court.<\/span><\/p>\n<p class=\"paragraph\" style=\"margin: 0in; margin-bottom: .0001pt; text-align: justify; vertical-align: baseline;\"><span class=\"normaltextrun\"><span style=\"color: black;\">Arguments were submitted to the Court on the behalf of the Glasgow priest by Aidan O\u2019Neill QC, one of Scotland\u2019s leading human rights advocates, who called the ban \u201can extraordinary abuse of the state\u2019s power\u201d.<\/span><\/span><span class=\"eop\"><span style=\"color: black;\">\u00a0<\/span><\/span><\/p>\n<p class=\"paragraph\" style=\"margin: 0in; margin-bottom: .0001pt; text-align: justify; vertical-align: baseline;\"><span style=\"font-size: 9.0pt; font-family: 'Segoe UI',sans-serif;\">\u00a0<\/span><\/p>\n<p class=\"paragraph\" style=\"margin: 0in; margin-bottom: .0001pt; text-align: justify; vertical-align: baseline;\"><span class=\"normaltextrun\"><span style=\"color: black;\">\u201c[The blanket ban] has a fundamental chilling impact on worship and belief. It requires people in good conscience to choose between God and Caesar,&#8221;\u00a0said Aidan O\u2019Neill QC.<\/span><\/span><span class=\"eop\"><span style=\"color: black;\">\u00a0<\/span><\/span><\/p>\n<p><strong>Right to freedom of worship\u00a0upheld<\/strong><\/p>\n<p>The parish priest of St Alphonsus Church in the Calton area of Glasgow\u00a0had cited his\u00a0\u201cgrieving\u201d parish\u00a0as his inspiration for carrying the legal challenge forward, despite facing a sizeable financial burden. Canon White\u00a0takes\u00a0a\u00a0position of pastoral leadership over some of the most\u00a0economically-deprived\u00a0communities in the UK. He has appealed to the public\u00a0to\u00a0<a href=\"https:\/\/www.justgiving.com\/crowdfunding\/freedomforfaith\">support his\u00a0legal challenge\u00a0via Justgiving,<\/a>\u00a0where he has so far raised approximately 35% of his goal.\u00a0Efforts to cover the costs of the challenge remain ongoing.<\/p>\n<p>Human rights experts from ADF UK,\u00a0which\u00a0supported the case, have welcomed the\u00a0court\u2019s\u00a0decision.<\/p>\n<p>\u201cWe celebrate this decision with Canon Tom White, because the court has recognised that which the government did not \u2013 that freedom of religion and belief is a human right to be afforded the highest protection. In declaring the ban to be \u201cunlawful\u201d, the court helps ensure that people of faith will not again have their rights erased in this way.
