The buffer zone prevents harassment, intimidation, and \u201cinfluence\u201d of a person\u2019s decision to access abortion services. Docherty denies engaging in any of the prohibited activities.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Speaking to BBC Scotland\u2019s \u201cScotcast\u201d this week, Rose Docherty said that the experience had been \u201c<\/span><i><span data-contrast=\"auto\">alarming\u201d.\u00a0<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">In an exclusive broadcast with the BBC, Docherty explained that she had studied the Scottish \u201cbuffer zones\u201d law, which came into force in 2024, and had carefully chosen a sign that did not break any prohibitions. On the day in question, she stood quietly and peacefully near the hospital, not approaching anyone, in order to ensure that any conversations that took place were consensual.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><i><span data-contrast=\"auto\">\u201cI gave consideration to what I was doing&#8230;I looked at the law and saw what it said I couldn\u2019t do, and thought, ok, well this is what I can do&#8230;I can offer to listen, and if anyone wants to come and speak to me, they can do so, only if they want to come and speak with me ,\u201d <\/span><\/i><span data-contrast=\"auto\">she told the podcast.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Speaking later to ADF International, she reflected: \u201c<\/span><i><span data-contrast=\"auto\">there was nothing in my conduct or sign that could reasonably be considered harassing, alarming and distressing&#8221;.<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The offence of engaging in \u201cinfluence\u201d within the buffer zone (section 4 Abortion Services (Safe Access Zones) (Scotland) Act 2024) carries a maximum sentence of an unlimited fine. Docherty also told the BBC that she would even be \u201c<\/span><i><span data-contrast=\"auto\">willing to go to prison\u201d<\/span><\/i><span data-contrast=\"auto\"> over what had happened.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Commenting later on her words, Docherty added:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><i><span data-contrast=\"auto\">&#8220;I informed BBC that I would be willing to go to prison on the issue because I am unshakeably convinced that nobody should be criminalised for a peaceful offer to speak on any public land in Britain. <\/span><\/i><\/p><p><i><span data-contrast=\"auto\">&#8220;This is a free and democratic society, and no threat of imprisonment will change my mind that what I did was right, completely harmless and in accordance with the purpose and intention of international human rights laws.&#8221;<\/span><\/i><span still feel intimidated by the presence of pro-life individuals 200m from a hospital, the Green Party parliamentarian said: &#8220;<\/span><i><span data-contrast=\"auto\">I think it&#8217;s appropriate that we take those concerns seriously and the government take a look at whether an extension is appropriate or not.<\/span><\/i><span data-contrast=\"auto\">&#8220;<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Responding to recent efforts to expand the buffer zone, Docherty said <\/span><i><span data-contrast=\"auto\">\u201cI believe it wouldn\u2019t matter where we stood&#8230;it wouldn\u2019t matter how far they pushed the \u2018buffer zone.\u2019\u201d<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Speaking to ADF International, she added, \u201c<\/span><i><span data-contrast=\"auto\">It wouldn\u2019t matter where we stood \u2013201 meters, or 500 meters away \u2013 it seems the authorities would still try to crack down harshly and unfairly on individuals because the government simply disagree with their point of view. This is unjust \u2013 of course, there should be laws against harassment, and we all condemn such behaviour. But merely offering conversations near a hospital is not a crime.\u201d<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">A Scottish government spokeswoman told the BBC the act allows ministers to extend the size of a buffer zone if it is decided that the existing zone is not adequate.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">She added: <\/span><i><span data-contrast=\"auto\">&#8220;However, before taking such a step, it is essential that ministers are satisfied such an extension is appropriate.<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><i><span data-contrast=\"auto\">&#8220;We have engaged with the relevant health board to understand any impacts the anti-abortion activity outside of the safe access zone may be having on patients and staff.&#8221;<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d0ba665 elementor-widget elementor-widget-heading\" data-id=\"d0ba665\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Buffer zone law could ban prayer within homes \u2013 \u201cdepending on who\u2019s passing by the window\u201d  <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67b688c elementor-widget elementor-widget-text-editor\" data-id=\"67b688c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">In February, <a href=\"https:\/\/adfinternational.org\/en-gb\/news\/prayer-by-window-in-scotland-buffer-zone\">Gillian Mackay MSP admitted\u00a0<\/a>that prayer by a window in one\u2019s own home could be an offence within a buffer zone \u2013 depending on who is passing by.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Again speaking to BBC\u2019s \u201cScotcast\u201d Podcast, the Green Party Politician repeatedly denied that prayer was being criminalised under the law. But when asked if <\/span><i><span data-contrast=\"auto\">\u201cperformative prayer\u201d <\/span><\/i><span data-contrast=\"auto\">with<\/span><i><span data-contrast=\"auto\"> \u201cclasped hands\u201d, v<\/span><\/i><span data-contrast=\"auto\">isible from a window, could be prosecuted, she responded: <\/span><i><span data-contrast=\"auto\">\u201cwell, that depends on who\u2019s passing by the window\u2026\u201d<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The admission came despite previously accusing US President JD Vance of spreading \u201c<\/span><i><span data-contrast=\"auto\">shameless misinformation<\/span><\/i><span data-contrast=\"auto\">\u201d when he highlighted concerns that \u201c<\/span><i><span data-contrast=\"auto\">even private prayer within [people\u2019s] own homes may amount to breaking the law<\/span><\/i><span data-contrast=\"auto\">\u201d in his Munich Security Conference Speech earlier this year.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">Lois McLatchie Miller, Scottish spokesperson for ADF International, said:\u00a0<\/span><span data-ccp-props=\"{&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><p><i><span data-contrast=\"none\">\u201cThe \u2018buffer zones\u2019 law is fundamentally flawed when it comes to undermining basic freedoms of speech, thought, and religion.
