Their daughter, Alta, is ventilator dependent. She\u00a0is\u00a0being cared for in a small room in Manchester Royal Children\u2019s hospital. Her prognosis gives her two more years to live, but the NHS Trust want\u00a0to remove the support\u00a0even though they accept this will result in a much sooner death.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Avraham and Chaya\u00a0Fixsler, of Israeli and American citizenship, have fought with everything they have over the past few months to preserve the life of their daughter, as you or I would. They raised the money to transfer Alta to their Jewish homeland where she could continue treatment in hospital and then be buried in accordance with their religious beliefs and practices, gaining the support of the\u00a0<\/span><a href=\"https:\/\/www.timesofisrael.com\/health-minister-appeals-to-uk-counterpart-to-intervene-in-case-of-ill-toddler\/\"><span data-contrast=\"none\">Israeli Health Minister<\/span><\/a><span data-contrast=\"auto\">.\u00a0They received the backing of\u00a0<\/span><a href=\"https:\/\/www.rubio.senate.gov\/public\/index.cfm\/2021\/6\/rubio-colleagues-urge-biden-to-advocate-on-behalf-of-two-year-old-girl-s-life\"><span data-contrast=\"none\">American politicians<\/span><\/a><span data-contrast=\"auto\">\u00a0and a visa for her to be\u00a0<\/span><a href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-manchester-57990742\"><span data-contrast=\"none\">transferred to the US<\/span><\/a><span data-contrast=\"auto\">.\u00a0They have a medical team on standby to move her back home in England. They\u00a0have done everything\u00a0within their power\u00a0so she can remain alive.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">They took their case to the courts, challenging the NHS Trust\u2019s decision in the\u00a0<\/span><a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2021\/05\/Manchester-University-NHS-Foundation-Trust-v-Fixsler-judgment.pdf\"><span data-contrast=\"none\">High Court<\/span><\/a><span data-contrast=\"auto\">,\u00a0<\/span><a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2021\/07\/Fixsler-v-Manchester-University-NHS-Foundation-Trust-.pdf\"><span data-contrast=\"none\">Court of Appeal<\/span><\/a><span data-contrast=\"auto\">, and\u00a0<\/span><a href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-manchester-58074291\"><span data-contrast=\"none\">European Court of Human Rights<\/span><\/a><span data-contrast=\"auto\">.\u00a0But despite having everything in place to continue treatment without it costing the NHS a penny, the courts have denied them\u00a0what they believe is best.\u00a0The\u00a0Fixslers\u00a0were left\u00a0to watch and wait until the day when the hospital intentionally removes the\u00a0life-supporting treatment\u00a0and Alta dies.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The\u00a0courts are required to have the child\u2019s welfare as their \u201cparamount consideration\u201d under the\u00a0<\/span><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1989\/41\"><span data-contrast=\"none\">Children Act 1989<\/span><\/a><span data-contrast=\"auto\">,\u00a0which includes\u00a0the \u201cbest interests of the child\u201d test.\u00a0Yet, the legal intent to protect vulnerable children at risk of being abused or neglected has evolved into a legal precedent which\u00a0now\u00a0includes end-of-life scenarios and\u00a0overrides our\u00a0long-standing principle of parental primacy.\u00a0As Alta\u2019s parents\u00a0found out,\u00a0end-of-life clinical paternalism\u00a0is more\u00a0authoritative\u00a0to the courts\u00a0than the\u00a0heartfelt desires\u00a0or\u00a0religious convictions\u00a0of the parents\u00a0in determining the young child\u2019s\u00a0interests.\u00a0<\/span><a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2021\/07\/Fixsler-v-Manchester-University-NHS-Foundation-Trust-.pdf\"><span data-contrast=\"none\">Lord Justice Baker<\/span><\/a><span data-contrast=\"auto\">\u00a0in the Court of Appeal said that he \u201cdeeply\u00a0regrets\u201d that he could not do more to help Alta\u2019s devoted parents \u2013 whom he could not criticise \u2013 but that \u201cthe law required\u201d him to dismiss their appeal.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">How tragic\u00a0that the\u00a0Fixslers\u2019 views\u00a0and\u00a0values\u00a0about the sanctity of life\u00a0can be dismissed\u00a0when a court decides what their child\u00a0hypothetically \u2018would have wanted\u2019. How tragic that\u00a0they\u00a0have so far been denied taking their daughter to a place of central religious importance to them to enjoy two more years\u00a0together.\u00a0How tragic that the clinical\u00a0assessment of the child\u2019s pain neither\u00a0has to\u00a0be \u201cunbearable\u201d or \u201cintolerable\u201d for\u00a0the\u00a0application to withdraw treatment to succeed in the courts. The courts know that \u2018suffering\u2019 is\u00a0an extremely\u00a0subjective concept\u00a0<\/span><a href=\"https:\/\/www.thetimes.co.uk\/article\/our-courts-are-wrong-let-this-little-girl-leave-bjxmrtl0s\"><span data-contrast=\"none\">disputed by medical experts<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">But there\u2019s\u00a0<\/span><a href=\"https:\/\/www.thejc.com\/news\/uk\/family-in-last-ditch-attempt-to-stop-hospital-from-taking-toddler-off-life-support-1.519757\"><span data-contrast=\"none\">still time<\/span><\/a><span data-contrast=\"auto\">\u00a0for the Manchester Children\u2019s Hospital to relent and allow the\u00a0Fixslers\u00a0to choose\u00a0how best to care for\u00a0their young daughter\u00a0in her condition.\u00a0All\u00a0hopes are on\u00a0the clinicians changing their minds now.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">&#8211; by Elizabeth Francis<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The parents of a two-and-a-half-year-old girl find themselves in a thoroughly unenviable position.
