No one should fear prison time for stating biological facts or even just peacefully sharing their views online\u201d<\/span><\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f0a35a6 elementor-widget elementor-widget-heading\" data-id=\"7f0a35a6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Background<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-545ad7e4 elementor-widget elementor-widget-text-editor\" data-id=\"545ad7e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"none\">Nine Borges is a UK-based\u00a0academic researcher\u00a0with 265,000 followers on\u00a0<\/span><a href=\"https:\/\/www.instagram.com\/nine.borg\/?hl=en\"><span data-contrast=\"none\">Instagram<\/span><\/a><span data-contrast=\"none\">, where she is a prominent critic of transgender ideology.\u00a0In\u00a0<\/span><span data-contrast=\"auto\">a short, <\/span><a href=\"https:\/\/www.instagram.com\/reel\/C_d_kT-N-B7\/\"><span data-contrast=\"none\">online video<\/span><\/a><span data-contrast=\"none\">\u00a0posted\u00a0<\/span><span data-contrast=\"auto\">to\u00a0<\/span><span data-contrast=\"none\">Instagram in September 2024<\/span><span data-contrast=\"none\">,<\/span><span data-contrast=\"auto\">\u00a0in which she spoke to the camera from her home,<\/span><span data-contrast=\"none\"> she drew attention to concerns about the financing and influence of pro-LGBT organisations in Brazil and included criticism of Symmy Larrat, Brazil\u2019s LGBT National Secretary.\u00a0<\/span><span data-contrast=\"auto\">The video\u00a0drew\u00a0nearly 15,000\u00a0likes and 180,000 views.\u00a0<\/span><span data-contrast=\"none\">Larrat\u00a0is a man who identifies as a woman and describes himself on\u00a0<\/span><a href=\"https:\/\/x.com\/larratsymmy\"><span data-contrast=\"none\">social media<\/span><\/a><span data-contrast=\"none\">\u00a0using explicit terminology.\u00a0Larrat\u00a0filed a complaint over the video, prompting the Federal Police of Brasilia to open their first investigation into Nine\u2019s online content.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559738&quot;:240,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">In August 2025, Borges received formal notice that she was being investigated for \u201ctransphobia\u201d and \u201cdefamation,\u201d prompting her summons to appear before police on October 7, 2025.\u00a0\u00a0The following month, on November 5, police informed Borges that they would recommend moving the investigation forward to formal prosecution for \u201ctransphobia\u201d and \u201cmisgendering\u201d the LGBT Secretary\u2014an official who self-describes as a \u201ctransvestite\u201d and \u201cprostitute.\u201d Borges had used these same terms in her commentary, and police cited this as the basis for pursuing prosecution. ADF International is providing legal support to Borges as a result of the investigation.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">A 2019 ruling from Brazil\u2019s Supreme Federal Tribunal established \u201ctransphobia\u201d and \u201chomophobia\u201d as crimes, punishable with up to five years of jail time per count. Overstepping Congress, the Court created a crime without observing the legal and democratic process. Since then, numerous cases have emerged across Brazil in which individuals were charged with \u201ctransphobia\u201d for simply sharing their beliefs. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Most recently, <a href=\"https:\/\/adfinternational.org\/news\/brazilianveterinary-studentfaces-up-to-10-years-in-prison-for-social-media-comments-on-gender-ideology\">Isadora Borges<\/a> (not related to Nine Borges), a veterinary student in Brazil,\u00a0has been criminally prosecuted\u00a0for alleged \u201ctransphobic\u201d\u00a0comments made on X, with a potential prison sentence of up to 10 years.\u00a0Her first\u00a0<\/span><a href=\"https:\/\/adfinternational.org\/news\/brazilian-court-hears-case-of-veterinary-student-facing-up-to-10-years-in-prison-for-transphobic-social-media-comments\"><span data-contrast=\"none\">hearing<\/span><\/a><span data-contrast=\"auto\"> was held on February 10. In 2025, social media influencer Isabella Cepa faced criminal investigations for her online post about gender ideology. In another case, Assemblies of God Pastor Douglas Baptista faced criminal charges for authoring a book with a Christian view of sexuality. His case was legally supported by ADF International.
