The parents were convicted of \u201cintellectual neglect\u201d, with the judge stating that the home education curricula failed to include programs on \u201cgender and sex education\u201d and \u201ctolerance and diversity.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The\u00a0court\u00a0also\u00a0concluded\u00a0that because the girls, aged 15 and 11,\u00a0did not like \u201ctrap\u201d or\u00a0<\/span><span data-contrast=\"none\">&#8220;sertanejo&#8221; (folk) music, their home curriculum had also failed to properly\u00a0educate them in cultural diversity, despite the fact\u00a0that\u00a0they are\u00a0both accomplished pianists and\u00a0speak\u00a0multiple\u00a0languages.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The Denardis were initially sentenced by a lower court in S\u00e3o Paulo in April 2026. Now, they are appealing the ruling, challenging the state\u2019s attempt to imprison them for exercising their right to direct their children\u2019s education. Their sentence will be suspended pending the appeal, which will be heard by the 7 C\u00e3mara Criminal do Tribunal de Justi\u00e7a do Estado de S\u00e3o Paulo, the highest state court. ADF International is providing legal support for the appeal.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-74b17fe8 elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"74b17fe8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t<span style=\"color: #AF272F\">\u201cAs a mother, I cannot conceive a more dictatorial state than the one that wants me in jail because I chose to exercise my right to direct the education and upbringing of my daughters. <\/span>My husband and I are hopeful the court will recognize our right to choose the best education for our children and overturn this unjust conviction.\"\t\t\t<\/p>\n\t\t\t\t\t\t\t<div class=\"e-q-footer\">\n\t\t\t\t\t\t\t\t\t\t\t<cite class=\"elementor-blockquote__author\">-  Ieda Denardi<\/cite>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c48154 elementor-widget elementor-widget-text-editor\" data-id=\"5c48154\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">\u201c<\/span><i><span data-contrast=\"auto\">As a mother,\u00a0I cannot conceive a more dictatorial state than the one that wants\u00a0me in jail because I chose to exercise my right to direct the education and upbringing of my daughters.<\/span><\/i><span data-contrast=\"auto\">\u201d said Ieda Denardi. \u201c<\/span><i><span data-contrast=\"auto\">My husband and I are hopeful the court will recognize our right to choose the best education for our children and overturn this unjust conviction.\u201d<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The conviction came\u00a0despite\u00a0the prosecutor\u00a0recommending\u00a0that the court\u00a0acquit the parents.\u00a0After hearing the witnesses and evaluating the social and academic development of the\u00a0girls, the prosecutor concluded that the parents had not neglected their children.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">In his decision, the judge explicitly accused the parents of<\/span><i><span data-contrast=\"none\">\u00a0\u201cusing their daughters as pawns in an ideological struggle, subjecting them to a form of unregulated education, the effectiveness and quality of which lack adequate metrics within the Brazilian legal system, while completely excluding the State\u2019s involvement.\u201d<\/span><\/i><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The\u00a0Denardis\u2019\u00a0case\u00a0has\u00a0drawn congressional\u00a0attention, with\u00a0lawmakers\u00a0recently holding\u00a0hearings\u00a0at\u00a0which the\u00a0<\/span><a href=\"https:\/\/www.gazetadopovo.com.br\/vida-e-cidadania\/quem-e-o-casal-condenado-por-educar-as-filhas-em-casa-que-falou-ao-congresso\/\"><span data-contrast=\"none\">parents\u00a0urged\u00a0Congress<\/span><\/a><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">to act\u00a0in favor of homeschooling.\u00a0A homeschooling bill was approved in the\u00a0House of Representatives in\u00a02022,\u00a0but\u00a0has since stalled in the Senate, creating\u00a0legal uncertainty for parents who seek to homeschool their children.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><i><span data-contrast=\"none\">\u201cThe prosecutor examined the witnesses and\u00a0recommended for\u00a0acquittal. An independent educational psychologist found no sign of neglect. The girls themselves described rigorous daily education. The judge convicted anyway &#8211; because a fifteen-year-old said she finds some music lyrics morally questionable, and because the curriculum\u00a0didn\u2019t\u00a0include state-approved content on gender. A parent has been sentenced to prison not for\u00a0failing to educate\u00a0her children, but for educating them according to her own values. This is a grotesque abuse of the criminal law, and we will not let it stand.<\/span><\/i><span data-contrast=\"none\">\u201d said Julio Pohl, Legal Counsel for Latin America at ADF International.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5109b3c6 elementor-widget elementor-widget-heading\" data-id=\"5109b3c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Background<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-115a73d8 elementor-widget elementor-widget-text-editor\" data-id=\"115a73d8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Despite\u00a0<a href=\"https:\/\/www.aned.org.br\/index.php\/conheca-educacao-domiciliar\/ed-no-brasil\"><span data-contrast=\"none\">over 70,000 children<\/span><\/a><span data-contrast=\"auto\">\u00a0currently\u00a0being\u00a0homeschooled in Brazil, the\u00a0lack of a clear\u00a0legal framework\u00a0has left many parents with\u00a0additional\u00a0obstacles when choosing home education.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">In 2019,\u00a0the Brazilian Supreme Court ruled that homeschooling\u00a0did not contravene the\u00a0Constitution,\u00a0but\u00a0required a\u00a0federal\u00a0law\u00a0to regulate it.\u00a0Homeschooling parents have relied on international law\u00a0to defend their right to direct the education of their children.\u00a0The\u00a0lack of\u00a0a\u00a0federal\u00a0law on the issue\u00a0has left\u00a0them in legal limbo and under\u00a0constant threat of\u00a0sanction.\u00a0One such parent who has faced pushback in the courts is\u00a0<\/span><a href=\"https:\/\/adfinternational.org\/cases\/regiane-cichelero\"><span data-contrast=\"none\">Regiane Cichelero<\/span><\/a><span data-contrast=\"auto\">, a\u00a0Brazilian\u00a0mother who was denied\u00a0the right to homeschool her\u00a0son\u00a0by a state court last year.\u00a0ADF International\u00a0is supporting\u00a0her appeal.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">However,\u00a0until now,\u00a0it has been treated as an administrative offense for\u00a0failing to register\u00a0the children in\u00a0school.\u00a0The Denardis\u00a0are\u00a0the first parents\u00a0to\u00a0be\u00a0criminally convicted for homeschooling their children.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The Denardi parents began homeschooling their daughters in 2020, after\u00a0observing\u00a0the shortcomings\u00a0of\u00a0the\u00a0public\u00a0education\u00a0system\u00a0during\u00a0pandemic-era remote\u00a0learning.\u00a0\u00a0Since they started\u00a0homeschooling, they\u00a0have seen\u00a0significant improvement in their daughters\u2019 academic\u00a0performance and\u00a0have\u00a0also enjoyed\u00a0being able to\u00a0incorporate their\u00a0faith and personal values into their learning.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d3e0957
