La Corte Constitucional tendr\u00e1 que responder a esta pregunta, al menos para Colombia. La estrella de las redes sociales Erika \u00abKika\u00bb Nieto, respondiendo a la pregunta de un espectador en un v\u00eddeo de \u00abPreg\u00fantame lo que quieras\u00bb, hab\u00eda compartido sus opiniones sobre las relaciones entre hombres y mujeres, y al mismo tiempo expres\u00f3 su tolerancia hacia los diferentes puntos de vista. Despu\u00e9s de que un activista se quej\u00f3 del v\u00eddeo, un tribunal nacional le neg\u00f3 su derecho a la libertad de expresi\u00f3n al ordenarle que retirara el mismo. Ahora, Nieto busca que la Corte Constitucional colombiana defienda su derecho a compartir libremente sus opiniones en la Internet.<\/p>\n<p>\u00abTodo el mundo deber\u00eda ser libre de compartir sus creencias en p\u00fablico. Quiero ser aut\u00e9ntica con mis seguidores sin ser censurada o temer sanciones penales s\u00f3lo por publicar un v\u00eddeo. No quiero que otros tengan miedo de expresar sus creencias. Al alzar mi voz, espero inspirar m\u00e1s tolerancia hacia las opiniones diferentes\u00bb, dijo Nieto.<\/p>\n<p><strong>Censurada por expresar su opini\u00f3n sobre el matrimonio\u202f<\/strong><\/p>\n<p>Respondiendo a la pregunta de un seguidor en su v\u00eddeo de YouTube, Nieto comparti\u00f3 con sus millones de seguidores sus creencias sobre el matrimonio entre un hombre y una mujer.\u202fDijo: \u201cDios creo al hombre y a la mujer para que el hombre est\u00e9 con la mujer y viceversa, considero que hombre con hombre y mujer con mujer no est\u00e1 bien, pero lo tolero.\u201d<\/p>\n<p>\u00abTodo el mundo deber\u00eda ser libre de expresar sus creencias y convicciones religiosas sin temor a la censura. El derecho de Kika Nieto a expresar libremente sus opiniones y compartirlas p\u00fablicamente est\u00e1 protegido por la Constituci\u00f3n colombiana. La libertad de expresi\u00f3n y la libertad religiosa son derechos humanos fundamentales garantizados por todos los principales tratados de derechos humanos. Si alguien se siente ofendido, la mejor respuesta es el debate, no la censura. Al final, cada uno de nosotros, y la misma democracia, somos los que sufrimos cuando no se permite hablar libremente\u00bb, dijo Tom\u00e1s Henr\u00edquez, Director de \u00c1rea para Am\u00e9rica Latina y el Caribe de ADF International, una organizaci\u00f3n de derechos humanos que apoya el caso de Kika Nieto.<\/p>\n<p><strong>Activistas presentaron denuncia judicial&nbsp;<\/strong><\/p>\n<p>En un caso anterior surgido del mismo video, la Corte Constitucional colombiana ya hab\u00eda dictaminado que el discurso de Nieto sobre el matrimonio est\u00e1 constitucionalmente protegido. Sin embargo, otro activista llev\u00f3 a Nieto frente a los tribunales, denunci\u00e1ndola por ese mismo comentario sobre el matrimonio, que \u00e9l consideraba ofensivo y discriminatorio. Esta vez, una corte menor consider\u00f3 que el v\u00eddeo conten\u00eda \u00abdiscurso de odio\u00bb y, por lo tanto, orden\u00f3 su retirada de YouTube.<\/p>\n<p>La ONG colombiana Nueva Democracia \u2014una plataforma de la sociedad civil que defiende la libertad de expresi\u00f3n y otros derechos fundamentales\u2014 representa a Nieto en este caso. Ahora piden a la Corte Constitucional que defienda las libertades fundamentales y anule la decisi\u00f3n la corte menor. ADF International apoya a Nueva Democracia.
