Throughout a 20-year-long legal battle, the municipality has sought to seize the Word of Life Church&rsquo;s property in Kaluga near Moscow. The global human rights organization ADF International has filed two applications on behalf of the church at the Court in Strasbourg. The Court\u2019s decision could impact the lives of more than 800 million Europeans in 47 countries, including Russia.<\/p><p>\u201cNo one should be persecuted because of their faith.\u00a0Religious worship in community is a fundamental right and\u00a0part of\u00a0the very essence of\u00a0a\u00a0church\u2019s existence and mission.\u00a0The\u00a0authorities in Kaluga\u00a0have\u00a0set bureaucratic hurdle\u00a0after hurdle\u00a0for this Christian minority\u00a0community\u00a0for\u00a0more than 20 years.\u00a0The current\u00a0prohibition\u00a0on the use of\u00a0the\u00a0church\u00a0building\u00a0takes this one step further and\u00a0violates\u00a0the right to\u00a0freely\u00a0practice\u00a0one\u2019s\u00a0faith.\u00a0We hope the\u00a0European Court of Human Rights\u00a0will hear\u00a0this case\u00a0and uphold religious freedom and church autonomy in Russia,\u201d said Lidia Rieder, Legal Officer for ADF International.<\/p><p><b>Congregation resorts to meeting in tent<\/b><strong>\u00a0\u00a0<\/strong><\/p><p>ADF International filed\u00a0a\u00a0first\u00a0application\u00a0on behalf of the church last October based on the authorities\u2019 refusal to recognize the church\u2019s ownership of the building.\u00a0Now,\u00a0a\u00a0second application\u00a0challenges\u00a0the\u00a0absolute ban on the use of the building,\u00a0which a Russian court imposed\u00a0in March 2020, and which\u00a0was\u00a0recently upheld by the Russian Supreme Court. Both cases join several similar cases before the European Court\u00a0of Human Rights\u00a0in which Russia employs bureaucratic technicalities as a pretext to stifle religious minorities.<\/p><p>The\u00a0evangelical Word of Life Church\u00a0bought the property in 2000, looking to convert it into a meeting place for their religious community. Despite fulfilling the legal requirements, Russian authorities allege that modifications to the building were conducted without a permit. They\u00a0refused\u00a0to recognize the church&rsquo;s ownership of the property and prohibited any use of the building\u00a0whatsoever\u00a0in\u00a0March\u00a02020.<\/p><p>Currently,\u00a0the congregation\u00a0has resorted to meeting\u00a0in a tent outside of the property. In\u00a0both\u00a0applications\u00a0to the European Court of Human Rights, ADF International argues\u00a0that the church\u2019s rights to freedom of religion and assembly were violated as they are denied the ability to meet and worship together\u00a0on\u00a0their property.<\/p><p><b>Restrictions\u00a0on\u00a0Religious Freedom in Russia<\/b><strong>\u00a0<\/strong><\/p><p>The US Commission on International Religious Freedom designated Russia as a \u2018country of particular concern\u2019\u00a0in its\u00a02020 annual report. According to the\u00a0document, police conduct raids on private homes and places of worship.\u00a0Religious minority groups report that local authorities have used anti-extremism laws to add religious texts to the government\u2019s list of banned books. Officials also prevent religious minority organizations from obtaining land and deny them construction permits for houses of worship.<\/p><p>A separate case\u00a0which raises similar issues\u00a0concerns\u00a0Pastor Vitaliy Bak and his\u00a0Baptist\u00a0congregation. They\u00a0used\u00a0a private\u00a0house\u00a0for religious\u00a0services in\u00a0Verkhnebakansky\u00a0in Southern Russia\u00a0until the authorities banned them from doing so.\u00a0In December 2019, ADF International\u00a0filed\u00a0<a href=\"https:\/\/adfinternational.org\/legal\/vitaliy-bak-v-russia\/\">their case<\/a>\u00a0at the European Court of Human Rights.\u00a0Amidst the pandemic, the city administration has\u00a0<a href=\"https:\/\/adfinternational.org\/news\/russian-pastor-may-be-forced-to-tear-down-his-house-for-hosting-religious-services\/\">filed a lawsuit<\/a>\u00a0and asked the local court in Novorossiysk to order the demolition of the house \u2013 in which several people live \u2013 simply because religious services were held there.\u00a0ADF International is representing Pastor Bak at the European Court of Human Rights.<\/p><p>\u201cEveryone has the fundamental right to choose their religion and practice it alone and with others, in public and in private.\u00a0By ratifying the European Convention on Human Rights, Russia has agreed to be held\u00a0to account\u00a0on its human rights\u00a0commitments. Respecting the religious freedom of its citizens is not just a right protected by the Convention, but a litmus test for democracy. We are hopeful that the Court will agree to hear the cases\u00a0of the\u00a0church\u00a0in Kaluga\u00a0as well as\u00a0Pastor\u00a0Bak\u2019s,\u201d said Robert Clarke, Deputy Director of ADF
